The first step to get your medical marijuana card in Florida is to have a Qualifying Health Condition. If you have a Qualifying Health Condition then you may be able to get your medical marijuana card. If a licensed physician certifies you for the program then you are able to obtain a medical marijuana card. 

In Florida there are twelve conditions that can qualify you for a Medical Marijuana Card. Some of the conditions that can qualify include but are not limited to the following:

  • Cancer
  • Epilepsy
  • HIV/AIDS
  • Chronic Pain
  • Glaucoma
  • PTSD
  • Multiple Sclerosis

If you have a medical condition not mentioned above but could benefit from cannabis may qualify you for your Medical Marijuana Card in Florida. After your initial consultation, your certification must be renewed every 7 months. We recommend making your follow-up appointment at least a month before the 7-month period completes to ensure there is no lapse in coverage.

Before you can get your Florida Cannabis ID card you must be seen by an approved physician. Once you have been approved by the physician you must submit an application to the Florida Medical Marijuana Card Program by along with these documents:

  • Proof of Florida Residency
  • Doctor’s Certification For Cannabis Use
  • Completed Florida Compassionate Use Program Application
  • Passport Photo

In order to possess medical marijuana you must have a valid Florida Cannabis Identification Card. You Florida Cannabis ID Card must be renewed annually for $75 in order for you to continue to purchase and possess Medical Marijuana. The Florida Department of Health has a department called the Office of Compassionate Use which regulates this program. The Florida Medical Marijuana Card Program was created in order to protect authorized cardholders from being prosecuted by the State for possession of medical marijuana as long as they are following the Florida specific rules related to Medical Marijuana. Marijuana is still illegal on the Federal level.

There are a number of approved dispensaries in the State of Florida where you can purchase Medical Marijuana once you have been approved and have received your Florida Medical Marijuana Card. You can purchase up to your 70 day supply at one time but most people only purchase enough for upcoming use. There are many products available from the dispensaries and different doses and strengths.   • Medical Marijuana is legal in Florida after the state passed Amendment Two in 2016, which allowed individuals to obtain and possess Cannabis for medical use.
  • You can possess up to your 70 day as determined by your certifying physician in the State of Florida.
  • Still illegal at the Federal level, you should not cross state with your Medical Marijuana. For those that do cross state lines, we recommend taking your prescription with you but you can still be prosecuted for possession of Marijuana.
  • Only Florida residents and those that are deemed seasonal residents meaning you have lived in Florida for over 30 days and have one of the following:
  • Up-to-date utility bill
  • Mail from a government agency from the past two months
  • Deed/mortgage for a Florida owned property
  • Lease for a rented property in Florida
  • You are not allowed to give or sell approved Medical Marijuana products to others without risk of prosecution.
  • Although you may be to use your Florida Medical Marijuana Card in other states, Florida does not allow reciprocity from other states.

Someone that is legally responsible for your health can be consider a legal representative or caregiver. This includes:

  • Parent or Guardian if the patient is under 18 years old
  • Any individual that has a Power of Attorney for the patient
  • Someone deemed a Caregiver by a Court Order/Authorization

This individual can purchase Medical Marijuana from the dispensary on your behalf as long as they have been registered with the State of Florida as your Legal Representative/Caregiver.
